Shriram Finance Limited (SFL) is a corporate agent for Shriram Life Insurance Company Limited (SLIC) for selling their life insurance products. Further click through, lead deposition, sale and service thereafter to the customer shall be based on the terms and conditions mentioned in the contract/document executed between the insurance company (SLIC) and the customer.
SFL is authorised by SLIC to showcase the products of SLIC on its platforms.
Definitions
USER: User means the visitor, customer or the advisor as the case may be.
Website: means the Website accessed through domain name or located at URL https://www.shriramfinance.in through which the products of SLIC are being offered to the users.
Interpretation
In the Terms and Conditions, all references to the customer, visitor and advisor being referred to in masculine gender shall be deemed to include the feminine gender; singular includes plural and vice versa; and the word "includes" should be construed to also mean "without limitation".
General Provisions
SLIC hereby grants users a non-exclusive, non-transferable, revocable right to use the Site solely for their use in accordance with this Agreement. The foregoing permission has been granted to Users subject to their agreeing to abide by this Agreement. Users shall abide by any other rules, procedures, policies, terms and conditions governing the Site that may be displayed from time to time on the Site. The information, accessible on and via the Site, is a property of SLIC and is protected by copyright and other intellectual property and proprietary rights. Without limiting the foregoing or expanding any of their rights hereunder, users agree that they will not publish, broadcast, retransmit, reproduce, commercially exploit, create any derivative of or otherwise disseminate such information in the Site or in any portion of the Site.
Modification
The facility shall be offered at the discretion of SLIC. SLIC reserves the right to add, amend, revise, suspend or cancel in whole or in part any of the services which are part of the facility, without any prior notice to the user, customer or advisor. Any addition, amendment, revision, suspension or cancellation shall be effective and binding on the Visitor, customer and the advisor. SLIC may introduce new services on the Website from time to time. The existence and availability of the new services will be notified on the Website as and when they become available and any revision in the Terms and Conditions will take place in accordance with these terms and conditions without any prior notice.
Indemnity
The User agrees to indemnify, defend and hold harmless both SLIC and SFL and their affiliates from and against any and all suits, losses, claims, demands, liabilities, damages, costs and expenses (including reasonable attorney's fees) arising from or relating to
- Their use of the Site;
- Their violation of any applicable law, statute, ordinance, regulation or any third party's rights. This obligation survives the termination of this User Agreement, or
- Their breach of this User Agreement or any representations, warranties or covenants made by them herein.
Disclaimer & Warranty
- The website and all information available is provided "As is" and "As available", "without warranty of any kind, either expressed or implied, including without limitation.
- The website is maintained by SFL and the user’s use of the Website is subject to the terms and conditions and all applicable Indian laws. The Courts of Mumbai shall have exclusive jurisdiction over any dispute arising out of these terms and conditions. This Website is offered to user on the condition that the user accepts the terms and conditions contained herein without modification or reservation or qualification of or in respect of any of the terms, conditions and notices contained herein prior to using, accessing and browsing this Website, and also acknowledges that any other agreement between user and SFL/SLIC to the extent contrary to the terms and conditions are superseded and of no force or effect.
- This Website may contain links to other websites, web pages and services. User use of each such website, web page and services on any other website or web service is subject to the terms and conditions, if any, of the respective website or web service.
- SFL/SLIC expressly disclaim all warranties of any kind, whether express, implied, constructive or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy and completeness, and any warranties relating to non-infringement in the Facility.
- SFL/SLIC shall not be responsible or liable for the authenticity, accuracy, completeness, errors, omission, typographic errors, disruption, delay, interruption, failure, deletion, defect of any information, research, reports, analysis, quotes etc. in this Website or Facility or any part thereof.
- SFL/SLIC shall not incur any liability direct or indirect, to user or any third party, as a consequence of non-functioning of any equipment belonging to user/third party/SFL/SLIC. SFL/SLIC shall not be responsible for any downtime of such equipment.
- SFL/SLIC will not be liable for any virus that may enter user system as a result of user using the Website. SFL/SLIC also make no warranty to user or third parties that the Website would be virus free.
- The provisions of this clause shall survive the termination of these terms and conditions.
User Restrictions
(i) User shall not do any reverse engineering, decompile, disassemble, copy, reproduce, distribute, modify, transmit, perform, publish or create derivative works from or in any way exploit any of the Website in violation of the Terms and Conditions or the laws of any country.
(ii) User shall not Engage in any fraudulent, abusive or illegal activity, including but not limited to any communication or solicitation designed or intended to fraudulently obtain the password or any private information of any use.
(iii) User shall not use the Website to violate the security of any computer or computer network, crack passwords or security encryption codes, transfer or store illegal material including threatening or obscene material or engage in any kind of illegal activity.
(iv) SFL/SLIC is under no obligation and assumes no responsibility for any content being defamatory, libel, slander, falsehood, obscenity, pornography, profanity or danger posted on the Website by any unauthorised person. User is prohibited from posting or transmitting any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, profane or hate material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
(v) User shall not do any act or omission which is in contravention to applicable law or legal rights of any person.
Intellectual property Rights
(i) All the content on this Website including but not limited to appearance on the Website are protected by copyright, trademark, patent and other intellectual property laws of India.
(ii) The website, its content and/or all intellectual property rights pertaining thereto (including but not limited to copyrights, patents, trademarks and service marks) are owned by SFL/SLIC, and all rights, title and interest therein and thereto shall remain the property of SFL/SLIC.
(iii) Other company names and trademarks appearing in the website are the trademarks of their respective owners.
(iv) Users agree not to remove any copyright, trademark or other proprietary notice or legend contained on the website.
Limitation of Liability
In no event shall SFL/SLIC or their affiliates be liable for any indirect, incidental, special, punitive or consequential damages (including without limitation, damages for loss of data, business or profits) arising out of or in connection with this user agreement, the site, the inability to use the site or any advertising or products, services, or information purchased, obtained or stored in or from the site, or transactions entered into via the site, whether based on contract, tort, strict liability or otherwise, even if SFL/SLIC or their affiliates have been advised of the possibility of such damages, and notwithstanding the failure of the essential purpose of any remedy. However, In no event shall the liability of SFL/SLIC or their affiliates in any circumstance shall not exceed the amount paid by user. Without limiting the foregoing provisions of this paragraph, these limitations apply to any third party claims against users.
Miscellaneous
(i) User agree that no joint venture, partnership, employment, or agency relationship exists or is intended to be created between SFL/SLIC and the User as a result of these terms and conditions or usage of Website.
(ii) You acknowledge that any rights not expressly granted herein are reserved.
(iii) These terms and conditions constitute the entire agreement between SFL/SLIC and user with respect to this Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between us with respect to this Website.
(iv) SFL/SLIC will attempt to provide constant, uninterrupted access to the website. However, in the event SFL/SLIC is unable to provide or is delayed in providing access to the Users as a result of any event beyond the reasonable control, whether or not foreseeable and including, but not limited to acts of God, war, riot, insurrection, invasion, acts of enemy, embargoes, acts of civil or military authorities, labour strikes or shortages, hacking, governmental decree or regulation, court order, severe weather, fire floods, earthquakes, accidents, failure of suppliers, and breakdown in systems, communications or transport facilities, SFL/SLIC will not be liable for any loss or damage of any sort.
(v) If any provision of the Agreement shall be deemed unlawful, void or for any reason, unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
(vi) The clause headings in these terms and conditions are only for convenience and do not affect the meaning of the relative term.
